Terms of Service for Settling In Concierge Mobile App

Welcome to Settling In Concierge (“we,” “us,” or “our”), a mobile application available at www.settlinginapp.com designed to assist users with relocation and concierge services related to buying, selling, or renting a home. These Terms of Service (“Terms”) govern your use of the Settling In Concierge mobile application (the “App”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Eligibility
The App is intended for individuals who are at least 18 years old and are buying, selling, or renting a home in the United States. You represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and truthful.
2. Services
The App provides concierge services, including but not limited to:
- Offering local recommendations (e.g., real estate agents, movers, or utilities).
- Coordinating appointments or services related to relocation.
- Providing general guidance for settling into a new home.
We strive to provide accurate and helpful services, but we do not guarantee the availability, accuracy, or outcome of any recommendations or services. You are responsible for verifying the suitability of any third-party services or vendors we may recommend.
3. Account Registration
To use the App, you may need to create an account by providing contact details (e.g., name, email, phone number, address). You agree to:
- Provide accurate and current information.
- Maintain the security of your account credentials.
- Notify us immediately of any unauthorized access to your account at support@settlinginconcierge.com.
We reserve the right to suspend or terminate your account if you provide false information or violate these Terms.
4. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:
- Use the App to engage in illegal, fraudulent, or harmful activities.
- Attempt to gain unauthorized access to the App, its servers, or other users’ accounts.
- Upload or transmit viruses, malware, or other harmful code.
- Reproduce, modify, or distribute the App’s content without our permission.
- Impersonate others or misrepresent your affiliation with any person or entity.
We may suspend or terminate your access to the App if you violate these rules.
5. Intellectual Property
The App, including its design, text, graphics, logos, and software, is owned by or licensed to Settling In Concierge and protected by U.S. copyright and trademark laws. You may not copy, modify, distribute, or create derivative works from the App’s content without our prior written consent. You are granted a limited, non-transferable, non-exclusive license to use the App for personal, non-commercial purposes, subject to these Terms.
6. Disclaimers
The App and its services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Guarantees that the App will be uninterrupted, error-free, or secure.
- Accuracy or reliability of any recommendations or information provided.
We are not responsible for the actions, services, or performance of third parties (e.g., vendors or service providers) recommended through the App.
7. Limitation of Liability
To the fullest extent permitted by law, Settling In Concierge, its affiliates, officers, directors, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App. This includes, but is not limited to, damages for:
- Loss of data, profits, or business opportunities.
- Errors or interruptions in the App’s functionality.
- Outcomes of third-party services or recommendations.
Our total liability for any claim related to the App will not exceed $100 USD.
8. Indemnification
You agree to indemnify and hold harmless Settling In Concierge, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable attorneys’ fees) arising from:
- Your use of the App.
- Your violation of these Terms.
- Your violation of any third-party rights, including intellectual property or privacy rights.
9. Termination
We may suspend or terminate your access to the App at our sole discretion, with or without notice, if you violate these Terms or for any other reason, including but not limited to operational or legal requirements. You may stop using the App at any time. Upon termination, your account will be deactivated, and these Terms will no longer apply, except for sections that survive termination (e.g., Intellectual Property, Limitation of Liability).
10. Changes to These Terms
We may update these Terms to reflect changes in our services or legal requirements. We will notify you of significant changes via email or an in-app notice at least 30 days before they take effect. The updated Terms will be posted on our website with a revised effective date. Your continued use of the App after the effective date constitutes acceptance of the updated Terms.
11. Governing Law and Dispute Resolution
